Waiver of Liability for Sauna Rental

Waiver and Release of Liability Agreement

This Waiver and Release of Liability Agreement (“Agreement”) is entered into by and between Heat Retreat (the “Company”) and the undersigned renter(s) (the “Customer”).

  1. Acknowledgement of Risks:

    • The Customer understands and acknowledges that using the wood burning sauna may involve inherent risks, including but not limited to risks of injury, heat-related illness, burns, dehydration, or damage to personal property. The Customer voluntarily assumes full responsibility for these risks.

    • The Customer is responsible for all additional guests not accounted for by Heat Retreat at the time of booking, and will assume all risks associated with additional guests using the sauna.

  2. Release of Liability:

    • The Customer releases and forever discharges Heat Retreat, its owners, employees, and agents from any and all liability, claims, demands, actions, or causes of action arising out of any damage, injury, or death while using the sauna.

  3. Indemnification:

    • The Customer agrees to indemnify and hold harmless Heat Retreat from any claims, demands, or suits resulting from the use of the sauna. This includes covering all legal fees incurred by Heat Retreat in defense of such claims.

  4. No Medical Conditions:

    • The Customer certifies that they do not have any medical conditions that would be aggravated by using the sauna, and they will not hold the Company responsible for any health complications arising from sauna use.

    • If the Customer is unsure of any underlying medical conditions that may disqualify them from use of the sauna, the Customer agrees to conduct their own research and consult a physician prior to use.

  5. Use by Minors:

    • The Customer acknowledges that minors must be supervised by an adult at all times while using the sauna and assumes full responsibility for the supervision of minors.

  6. Understanding of Agreement:

    • The Customer acknowledges that they have read and understand the terms of this Agreement and voluntarily agree to them.

Sauna Rental Agreement

This Rental Agreement is made between Heat Retreat (the “Company”) and the undersigned renter(s) (the “Customer”) for the rental of a mobile sauna unit.

  1. Rental Period:

    • The Customer agrees to pick-up the sauna at 3:00pm or later on the day of their rental and return the sauna no later than 11:00am on the day of return. The Customer agrees to return the sauna by the agreed-upon date and time. Late returns will incur an additional fee of $150 per day. If the Customer requires Heat Retreat to pick-up the sauna, Heat Retreat reserves the right to pick-up before the agreed upon time on the day of return and the Customer will be subject to additional delivery fees. 

  2. Rental Fee:

    • The amount must be paid in full before the sauna is delivered. A deposit is required to secure the booking.

  3. Deposit and Damage Policy:

    • A refundable security deposit will be held by the Company. This deposit will be refunded within [2] days after the sauna is returned in the same condition it was delivered. The Customer agrees to cover any damage or excessive cleaning costs resulting from improper use.

  4. Delivery and Setup:

    • The Company will deliver and set up the sauna at the Customer’s specified location. The Customer agrees to provide safe access to the location and ensure that the sauna is placed on a level, solid surface.

  5. Customer Pick-up/Drop-off:

    • The Customer agrees to accept all responsibilities of transportation of the sauna/trailer.

    • The Customer agrees they possess a valid drivers license and automobile insurance as well as the ability to safely tow a recreational trailer of this variety.

    • The Customer agrees to use all equipment provided by Heat Retreat for the safe set-up and use of the sauna. 

    • The Customer agrees to set up the sauna on a flat and level surface before operating. 

  6. Proper Use:

    • The Customer agrees they are able to use the provided fire extinguisher should the need arise during the rental period.

    • The Customer agrees to follow all instructions provided by the Company for the proper use and care of the sauna. The Customer will not use the sauna for purposes other than its intended use.

    • Prohibited uses include:

      • Use of alcohol or illegal substances in the sauna.

      • Allowing individuals under the influence to use the sauna.

      • Submerging electrical components or heaters in water.

  7. Health Conditions:

    • The Customer acknowledges that sauna use may not be suitable for individuals with certain medical conditions, and it is their responsibility to consult a healthcare professional before use. The Company is not responsible for any health issues that arise from sauna use.

  8. Indemnification:

    • The Customer agrees to indemnify and hold harmless [Your Business Name] from any claims arising out of the use of the sauna.

  9. Termination of Agreement:

    • The Company reserves the right to terminate this agreement at any time if the Customer breaches the terms and conditions or if the sauna is used improperly.

  10. Waiver of Liability:

    • The Customer agrees to sign a separate waiver of liability, acknowledging the risks associated with sauna use.
